However, some funeral directors have claimed that cardboard funeral caskets and coffins are illegal. Or they may claim that the caskets are unsuitable for cremations or burials etc. Unfortunately, these funeral directors are in breach of Section 52 of the Trade Practices Act which covers misleading or deceptive conduct. The Act states the following: -.

“(Section 52) prohibits conduct by business that is misleading or deceptive, or likely to mislead or deceive. Generally, sellers must tell the truth or refrain from giving an untruthful impression. Failure to disclose material information may in some circumstances be a breach of the Act.”

If such a claim is made by your funeral director, then we recommend the following actions: -

Remind the funeral director regarding the above section of the Trade Practices Act. If you choose to use an OnEarth funeral casket as part of your funeral arrangements, then the funeral director can not deny you using our caskets based on claims of illegality or unsuitability of the casket.

Ask the funeral director exactly what legislation they are referring to. If the funeral director can produce in writing the relevant State legislation that shows that cardboard funeral caskets are illegal, then OnEarth Australia will provide a FREE casket to you. Notify the Australian Competition and Consumer Commission (ACCC) that the funeral director has undertaken such misleading conduct. The ACCC hotline is 1300 302 502. The more people who notify the ACCC regarding this issue, then the ACCC will be more likely to act to stop such unconscionable behaviour.
